Probate Filing Fees
Fees follow the statewide schedule in SCPA 2402. The amount depends on estate value. The scale starts at $45 for estates under $10,000. It goes to $75 for $10,000 to $20,000. Estates from $20,000 to $50,000 pay $215. The fee is $280 between $50,000 and $100,000. From $100,000 to $250,000, it costs $420. Estates between $250,000 and $500,000 pay $625. The maximum fee is $1,250 for estates over $500,000.
Will contests bring extra costs. Filing objections under SCPA 1410 is $150. A jury demand adds $150 more. Small estates under $50,000 can use the voluntary administration process under SCPA Article 13, which costs less and wraps up faster.
How Probate Works for Islip Residents
When an Islip resident dies with a will, the executor files a petition at the Suffolk County Surrogate's Court. The original will must be submitted. No copies. A death certificate goes with it. The court reviews the will under SCPA Article 14 and, if everything checks out, issues letters testamentary. This gives the executor the legal power to act on behalf of the estate.
Without a will, someone must petition for letters of administration. The court follows the priority list in SCPA 1001 to decide who gets appointed. The surviving spouse has first priority. After that, it goes to children, grandchildren, parents, and then siblings. An administrator usually needs a surety bond unless the court says otherwise.
Guardianship cases for Islip minors and incapacitated adults also go through this court. The Surrogate can appoint a guardian of the person, the property, or both. Trust disputes, accountings, and wrongful death cases round out the court's work.

NYSCEF runs around the clock and sends email alerts about new filings and court orders. You can pay fees by credit card through the system.
