Filing Probate in Brookhaven

When a Brookhaven resident dies with a will, the named executor files a probate petition at the Suffolk County Surrogate's Court. You must bring the original will. The court does not accept copies. A certified death certificate is required too. The petition lists the heirs, the estimated estate value, and asks the court to admit the will under SCPA Article 14.

If there is no will, you file for administration instead. The court picks an administrator following the rules in SCPA 1001. The spouse has first right. Then children, then parents. The administrator must post a bond unless the court waives it. Small estates worth $50,000 or less can skip the full process and use voluntary administration under SCPA Article 13.

The Town of Brookhaven has offices at 1 Independence Hill in Farmingville, phone (631) 451-6200. But the town has no role in probate. It handles local permits and services only. All estate matters go through Riverhead.
