Probate Court Records Filing Fees

Warren County fees follow the state schedule under SCPA 2402. The amount is based on the gross estate value. Estates under $10,000 pay $45. From $10,000 to $20,000, the fee is $75. Between $20,000 and $50,000 it costs $215. Estates from $50,000 to $100,000 pay $280. The $100,000 to $250,000 range is $420. From $250,000 to $500,000, you pay $625. And estates of $500,000 or more cost $1,250.

If a will is contested, more fees apply. Objections under SCPA 1410 cost $150 to file. A jury trial demand is $150. Filing a note of issue is $45. Certified copies cost $6 per page. Searching and certifying a record less than 25 years old is $30. For records over 25 years, the search and certification fee is $90.

Types of Probate Court Records in Warren County

When a person dies with a will, the executor files for probate. The court checks the will under SCPA Article 4. The original will must be submitted. No copies.

If there is no will, the case goes through administration. The court names an administrator. The spouse has first right. After that come children, parents, and other family members in the order set by law. Small estates under $50,000 can use the voluntary administration process. It is faster and the fees are lower.

Warren County Surrogate's Court also takes guardianship cases for minors and adults who cannot manage their own affairs. Trust proceedings, accountings, and wrongful death actions come through here too. Adoptions are filed at this court, but those records are sealed. Estate tax returns filed between May 1990 and January 2001 are sealed as well. Guardianship files and any documents containing social security numbers have restricted access under court rules.
