Types of Probate Court Records in Tioga County

Probate is the most common type of case. It happens when a person dies with a valid will. The named executor files a petition, and the court checks the will under SCPA Article 4. The original will must be filed. Copies do not work.

Administration cases come up when there is no will. The court picks an administrator based on state law. Spouses have first priority. Then children. Then parents. Small estates worth $50,000 or less can use the voluntary administration process. This is faster and cheaper. The fee for an estate under $10,000 is just $45.

The Tioga County Surrogate's Court also handles guardianship cases for minors and adults who cannot care for themselves. Trust cases, accountings, and wrongful death claims go through this court too. Adoption cases are filed here, but those records are sealed for good. Estate tax returns from May 1990 to January 2001 are also sealed. Documents with social security numbers have restricted access.
