Types of Probate Court Records in Herkimer County

Herkimer County Surrogate's Court handles the full range of estate proceedings. Probate is filed when someone dies with a will. The executor petitions the court to prove the will under SCPA Article 4. Only the original will is accepted. All interested parties must be notified and get a chance to be heard.

Administration proceedings apply when no will exists. The court appoints an administrator based on the priority set by state law. Spouses come first, then children, then grandchildren. Small estates worth $50,000 or less can use voluntary administration. The lower fee and simpler process make this a good choice for straightforward situations. Many estates in Herkimer County fall in the lower value ranges, so voluntary administration comes up fairly often.

Guardianship cases for minors and incapacitated adults go through this court. Trust proceedings, estate accountings, and wrongful death actions are part of the court's work as well. Adoption records are filed here but remain sealed. Herkimer County has a mix of Mohawk Valley properties and Adirondack mountain land. Estate cases sometimes involve seasonal properties in Old Forge and the surrounding lake communities alongside homes and businesses in the more populated southern part of the county.

Historical Probate Court Records

Herkimer County has probate court records going back to 1791 when the county was created from Montgomery County. That is more than 230 years of estate files. The early records document the lives of Mohawk Valley settlers and the growth of communities along the Erie Canal route. Before 1791, estate records for the area were filed in Montgomery County (and before 1772, in Albany County under the name Tryon County).

FamilySearch has microfilmed many older Herkimer County probate records. The records are indexed by surname. The Herkimer County NYGenWeb site has a Wills and Deeds Bulletin Board with multiple parts covering historical estate documents. The site has been a resource for genealogists since 1996 and contains census transcriptions, vital records, military history, and obituaries in addition to the wills and deeds sections.

The New York State Archives in Albany holds additional early records from the county. For researchers tracing families in the Mohawk Valley, the combination of the Surrogate's Court files, the County Clerk's recorded documents, and the online genealogical resources provides a strong foundation for estate research in this part of the state.

Online Records Security Update

As of March 1, 2025, the Herkimer County Clerk has adjusted online access to records in response to deed fraud and the practice of "harvesting signatures" from recorded documents. Searching and viewing index information remains free of charge. However, viewing images of the actual documents now requires payment through the SearchIQS system. This change was made to protect property owners from identity theft and fraudulent transfers.

The Clerk offers a free fraud alert service. You can sign up at the SearchIQS website and enter up to three names to monitor. When any document is recorded under those names, you get an email alert. This is a good way to keep watch over your property records. The service costs nothing and takes only a few minutes to set up.
