Not all records are public. Adoption files are sealed permanently. Guardianship documents have limited access. Death certificates filed with the court, social security numbers, and tax returns from May 1990 through January 2001 are restricted. These limits come from the 2014 amendments to the Uniform Rules for Surrogate's Courts.

Filing Fees
Probate filing fees in Oneida County follow the statewide schedule under SCPA 2402. The fee is tied to the estate's gross value. Under $10,000 is $45. Between $10,000 and $20,000 costs $75. From $20,000 to $50,000 is $215. Estates from $50,000 to $100,000 pay $280. The $100,000 to $250,000 range is $420. From $250,000 to $500,000 costs $625. Over $500,000 requires $1,250.
Contested cases come with extra fees. Filing objections under SCPA 1410 is $150. A jury trial demand costs $150. A note of issue is $45. Certified copies are $6 per page. Record searches cost $30 if the record is under 25 years old, or $90 for older ones.
Types of Cases
Probate is for estates where the deceased left a valid will. The executor files a petition along with the original will. The court checks the will under SCPA Article 4. Only original wills are accepted.
Administration applies when there is no will. The court names an administrator using New York's priority order: spouse, then children, then parents, then more distant relatives. Small estates under $50,000 may qualify for voluntary administration, which is a quicker and cheaper path.
Other matters at this court include guardianship, trusts, accountings, wrongful death claims, and adoptions. Adoption files are sealed and cannot be accessed without a court order. You can also file a will for safekeeping with the Surrogate's Court while the person is still alive. The fee for that is $45.
