Filing Probate from North Hempstead

When a North Hempstead resident dies with a will, the executor takes the original will and a death certificate to the Nassau County Surrogate's Court. A petition is filed under SCPA Article 14. The court reviews the will and, if valid, issues letters testamentary to the executor.

Without a will, someone petitions for letters of administration. The court uses the priority order in SCPA 1001 to pick the administrator. Spouses come first. Then children, grandchildren, parents, and siblings. A bond is usually required.

For small estates under $50,000, the voluntary administration process under SCPA Article 13 is available. It is faster and costs less. Guardianship and trust matters also go through this court.
