Types of Probate Cases
Probate is for estates with a will. The executor files a petition and the original will. The court reviews it under SCPA Article 4. Only originals are accepted. If approved, the court issues letters testamentary.
Administration is for when there is no will. The court appoints an administrator. Spouses get first priority, then children, then parents. Estates under $50,000 can use voluntary administration. It is a simpler path with lower fees. For estates under $10,000, the fee is only $45.
