Some records have restricted access. Adoption files are sealed permanently. Guardianship papers, death certificates on file with the court, documents with social security numbers, and estate tax returns from May 1990 through January 2001 are not available to the public.

Colonie Probate Filing Fees

Certified copies are $6 per page. Searching a record under 25 years costs $30. Records over 25 years cost $90 to search. Objections filed under SCPA 1410 cost $150. A jury demand is $150 more. A note of issue runs $45.
Small estates worth $50,000 or less can use voluntary administration. The fee for estates under $10,000 is just $45. This process is simpler and avoids the full probate procedure.
Types of Estate Cases for Colonie Residents
Probate applies when someone dies with a will. The named executor files a petition and the original will. The court checks it under SCPA Article 4. If approved, the executor gets letters testamentary and can start managing the estate.
